Introduction

Welcome to Paws of Fate! These Terms of Service ("Terms") govern your access to and use of the Paws of Fate mobile application and related services (collectively, the "Service") provided by Kruse Consultants, LLC ("we," "us," or "our").

By accessing or using Paws of Fate, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Eligibility

Age Requirement

You must be at least 13 years old to use Paws of Fate. By using the Service, you represent and warrant that you are at least 13 years of age. If you are under 18, you represent that you have obtained permission from your parent or legal guardian to use the Service.

Account Registration

To access certain features of Paws of Fate, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

Geographic Restrictions

Paws of Fate is currently available only to users located in the United States. By using the Service, you represent that you are located in the United States.

2. Acceptable Use

Permitted Uses

You may use Paws of Fate to:

• Create and manage profiles for your pets
• Generate and view pet horoscopes and astrological insights
• Share your pets' profiles with the community
• View and interact with other users' pet profiles
• Comment on posts within the community
• Store pet care information and veterinary records

Prohibited Conduct

You agree not to:

• Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Post content that infringes on any patent, trademark, trade secret, copyright, or other intellectual property rights
• Share false, misleading, or deceptive content
• Post content containing viruses, malware, or other harmful code

Platform Abuse:

• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
• Engage in spamming, phishing, or any form of unsolicited advertising
• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Use automated scripts, bots, or crawlers to access the Service
• Reverse engineer, decompile, or disassemble any aspect of the Service

Community Violations:

• Harass, bully, stalk, or harm other users
• Engage in hate speech or discriminatory conduct
• Share private information about others without consent
• Create multiple accounts to evade bans or restrictions
• Encourage or facilitate violations of these Terms

Animal Welfare:

• Post content depicting animal abuse, cruelty, or neglect
• Use the Service to facilitate illegal activities involving animals
• Share content that promotes harm to animals

3. Content and Intellectual Property

Your Content

You retain ownership of all content you post to Paws of Fate, including pet profiles, photos, comments, and other materials ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute your User Content in connection with operating and providing the Service.

Content Moderation

We reserve the right, but have no obligation, to:

• Monitor, review, and remove User Content that violates these Terms
• Suspend or terminate accounts that violate these Terms
• Preserve User Content and disclose it if required by law or to protect our rights

You acknowledge that we do not pre-screen User Content and that you use the Service at your own risk.

Our Intellectual Property

The Service, including its software, design, text, graphics, logos, and other content (excluding User Content), is owned by Kruse Consultants, LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

Copyright Infringement

We respect intellectual property rights. If you believe your copyright has been infringed, please contact us at info@kruseconsultants.com with:

• A description of the copyrighted work
• The location of the infringing material
• Your contact information
• A statement of good faith belief that the use is not authorized
• A statement that the information is accurate and you are authorized to act on behalf of the copyright owner

4. Premium Subscription and Payments

Free Trial

New users are eligible for a 7-day free trial of Paws of Fate Premium features. The trial begins when you register your account. You will not be charged during the trial period.

Premium Subscription

After your free trial ends, continued access to Premium features requires a paid subscription. Premium features may include:

• Unlimited pet profiles
• Advanced astrological insights and moon sign calculations
• Enhanced compatibility analysis
• Ad-free experience
• Priority customer support
• Additional features as we develop them

Billing and Payment

• Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your selected plan)
• Payment will be charged to your chosen payment method at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage or cancel your subscription through your account settings or your device's app store settings
• No refunds are provided for partial subscription periods

Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• You will retain access to Premium features until the end of your paid period
• No refunds will be issued for unused portions of a subscription period

Price Changes

We reserve the right to change subscription prices with at least 30 days' notice. Price changes will not affect your current subscription period but will apply upon renewal.

Payment Processing

Payments are processed through third-party payment processors. By providing payment information, you agree to their terms and authorize charges to your payment method.

5. Account Suspension and Termination

Termination by You

You may delete your account at any time through the app settings. Upon account deletion:

• All pet profiles will be permanently deleted
• All posts and comments will be permanently deleted
• Your email address will be retained for 30 days to allow account restoration
• After 30 days, all data, including email, will be permanently deleted
• Active subscriptions will be canceled, but no refunds will be provided for unused time

Account Restoration

You may restore your deleted account within 30 days by logging in with your original credentials. After 30 days, restoration is not possible.

Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violations of these Terms
• Fraudulent, illegal, or harmful activity
• Extended periods of inactivity
• Requests from law enforcement or government agencies
• Any other reason at our sole discretion

If we terminate your account for Terms violations, you may not be eligible for a refund of any subscription fees.

6. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.

• We collect information you provide (account details, pet information, photos)
• We use Google Gemini AI to generate horoscope content
• We use Supabase for data storage
• We do not sell your personal information
• We implement security measures to protect your data
• You have rights to access, correct, and delete your data

7. AI-Generated Content and Disclaimers

Astrological Content

Paws of Fate uses artificial intelligence (Google Gemini) to generate pet horoscopes, compatibility insights, and astrological content. This content is:

• Provided for entertainment purposes only
• Not based on scientific fact
• Not a substitute for professional veterinary advice
• Generated by AI and may contain errors or inaccuracies

No Professional Advice

The Service does not provide professional veterinary, medical, or behavioral advice. Any health, care, or behavioral information provided through the Service is for informational and entertainment purposes only. Always consult with a qualified veterinarian for your pet's health and care needs.

Pet Care Records

While you may store veterinary records and pet care information in the app, we are not responsible for:

• Accuracy or completeness of information you enter
• Loss of data due to technical issues, account deletion, or other causes
• Medical decisions you make based on information stored in the app

We strongly recommend maintaining backup copies of important veterinary records.

8. Disclaimers and Limitations of Liability

Service "As Is"

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• Results obtained from the Service will be accurate or reliable

Limitation of Liability

Indemnification

You agree to indemnify, defend, and hold harmless Kruse Consultants, LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party

9. Third-Party Services and Links

Paws of Fate integrates with and may contain links to third-party services, including:

• Google Gemini AI for horoscope generation
• Supabase for data storage
• Payment processors for subscription billing
• App stores (Apple App Store, Google Play Store)

These third-party services are governed by their own terms and privacy policies. We are not responsible for:

• The content, accuracy, or practices of third-party services
• Any damages or losses resulting from your use of third-party services
• Changes to or discontinuation of third-party services

Your interactions with third parties are solely between you and those parties.

10. Modifications to the Service and Terms

Service Changes

We reserve the right to:

• Modify, suspend, or discontinue any aspect of the Service at any time
• Change features, functionality, or availability of Premium features
• Impose limits on certain features or restrict access to parts of the Service

We will make reasonable efforts to notify you of significant changes, but we are not obligated to do so.

We may update these Terms from time to time. When we make material changes, we will:

• Notify you through the app or via email
• Give you the opportunity to review the changes before they take effect

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account.

11. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Florida and the United States, without regard to conflict of law principles.

Informal Resolution

Before filing a legal claim, you agree to contact us at info@kruseconsultants.com and attempt to resolve the dispute informally. We will do the same. This informal resolution process must continue for at least 30 days.

Arbitration Agreement

If we cannot resolve a dispute informally, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be settled by binding arbitration in accordance with the American Arbitration Association's rules, rather than in court.

Exceptions to arbitration:

• Small claims court disputes within jurisdictional limits
• Intellectual property disputes
• Requests for injunctive or equitable relief

Class Action Waiver

Venue

Any court proceedings (where arbitration does not apply) must be brought in the state or federal courts located in Volusia County, Florida, and you consent to personal jurisdiction in those courts.

12. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Kruse Consultants, LLC regarding the Service and supersede all prior agreements.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms and our rights and obligations without your consent.

Force Majeure

We are not liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

Survival

Provisions that by their nature should survive termination (including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability) will survive termination of these Terms.
